This General Terms and Conditions constitute an agreement between the User and Mobee regarding the procedures for using the Mobee Platform and trading Crypto Assets on the Mobee Platform.
The General Terms and Conditions are as follows:
1. Definition
All definitions and terms used in this General Terms and Conditions shall have the following meanings:
1.1. “Affiliate” means any party that directly or indirectly, controls, is controlled by, or is under common control with Mobee. The terms “control,” “controlled by” or “under common control” mean the entire authority of a party (whether an individual, corporation or otherwise) directly or indirectly, by way of holding shares or having voting rights in respect of a company or entity or by virtue of the authority set out in the articles of association or other document, to manage the company or entity and to conduct the affairs of the company or entity in accordance with the wishes of the party or to direct the management or policies of the company or entity or the authority to reject or overrule the principal policies of the company or entity.
1.2. “Crypto Assets” means a digital representation of value that can be stored and transferred using technology that enables the use of distributed ledgers such as blockchain to verify its transactions and ensure the security and validity of the stored information, is not guaranteed by a central authority such as a central bank but is issued by a private party, can be transacted, stored, and transferred or assigned electronically, and can be a digital coin, token, or other representation of an asset that includes backed crypto-assets and unbacked crypto-assets.
1.3. “OJK” means the Financial Services Authority of the Republic of Indonesia, which is a government agency whose main task is to provide guidance, regulation, development and supervision of digital financial asset trading.
1.4. “Mobee” means PT CTXG Indonesia Berkarya, and is a trademark owned by PT CTXG Indonesia Berkarya which has been registered and protected in accordance with applicable laws and regulations.
1.5. “Confidential Information” means as defined in Number 19.1 of this General Terms and Conditions.
1.6. “Force Majeure” means as defined in Number 21 of this General Terms and Conditions.
1.7. “User” means a party who accesses the Mobee Platform and/or who has registered and been verified on the Mobee Platform so that they can carry out Crypto Assets trading activities via the Mobee Platform.
1.8. “Dispute” means any dispute, controversy or claim arising out of, or in connection with or relating to this General Terms and Conditions.
1.9. “Mobee Platform” means the website, application, system, features, technology provided and managed by Mobee and used for trading Crypto Assets with the scope of activities as determined in this General Terms and Conditions.
1.10. “General Terms and Conditions” means this terms and conditions in relation to the trading procedures and use of the Mobee Platform.
1.11. “Wallet” means the media used to store Crypto Assets.
2. Mobee’s Profile
Mobee is a limited liability company established under the laws of the Republic of Indonesia, domiciled in District 8, Treasury Tower Floor 18, SCBD, Jalan Jenderal Sudirman Kavling 52-53, Senayan, Kebayoran Baru, South Jakarta Administrative City, Special Capital Region of Jakarta Province. 3. Risk of Crypto Assets Trading
3.1. The User understands that Crypto Assets are commodities that have quite high risks, including but not limited to the risk of price fluctuations, financial risks, and other risks that may be faced by the User when conducting Crypto Assets trading transactions on the Mobee Platform. All of these risks are entirely the responsibility of the User. Therefore, the User is advised to be careful and must have knowledge and/or experience in conducting Crypto Assets trading transactions, so that the User is able to evaluate and analyze the risk of Crypto Assets investment and has the ability to bear the financial risk of Crypto Assets investment.
3.2. The User understands and acknowledges that no representations or guarantees are made regarding the future value or trading volume of Crypto Assets.
4. Scope of Activities
4.1. The scope of activities that can be carried out on the Mobee Platform is as follows:
a. Sell and/or buy between Crypto Assets and Rupiah currency;
b. Exchange between 1 (one) or more types of Crypto Assets;
c. Storage of User’s Crypto Assets; and/or
d. Transfer or move Crypto Assets between Wallets.
4.2. In order to facilitate User and support the implementation of activities, Mobee can collaborate with other service providers, including but not limited to payment gateway service providers, electronic money service providers, and Crypto Assets storage service providers.
4.3. In the event that Mobee takes a position for itself, Mobee will pay attention to the following provisions:
a. act as a market maker or liquidity provider in transactions;
b. gives priority to User in taking buy or sell positions;
c. using Mobee’s own funds or Crypto Assets and funds must be placed in a separate account of the Futures Clearing Institution while Crypto Assets are placed with the Crypto Assets Storage Manager;
d. does not use the User’s funds or Crypto Assets;
e. convey the position-taking mechanism to the OJK, Futures Exchange, Futures Clearing Institution, and User; and
f. make separate records regarding its implementation.
5. Obligations and Responsibilities
5.1. User is required to comply with and obey all applicable laws and regulations in connection with the implementation of this General Terms and Conditions.
5.2. By reading and agreeing to this General Terms and Conditions and using the Mobee Platform, the User also agrees to changes, additions, replacements to this General Terms and Conditions that have been approved by OJK, as well as other policies and terms and conditions that are determined, displayed, and provided by Mobee on the Mobee Platform, along with changes, additions, replacements from time to time, which are an integral part of this General Terms and Conditions.
5.3. The User agrees to use the Mobee Platform only for activities as specified in this General Terms and Conditions, and will not use the Mobee Platform to carry out actions that are contrary to applicable laws and regulations, including but not limited to hacking, fraud, money laundering and terrorism financing. In this case, Mobee has the right and authority to monitor the User’s account.
5.4. The User agrees to bear the risk and be responsible for any actions taken by the User that result in a violation of this General Terms and Conditions and applicable laws and regulations, and other consequences that are detrimental to the User that arise as a result of the User’s negligence or error.
5.5. Each Mobee user is obliged to bear all tax obligations arising in relation with the implementation of this General Terms and Conditions in accordance with applicable laws and regulations.
6. User’s Account
6.1. To be able to carry out Crypto Assets trading transactions on the Mobee Platform, User is required to have an account and meet the following requirements:
6.1.1. For individual User:
a. Agree to abide by this General Terms and Conditions and be legally competent to agree to this General Terms and Conditions;
b. At least 17 (seventeen) years of age;
c. Has and provides to Mobee an Identification Card (identity document) for Indonesian citizens;
d. Has and provides a passport and identity card issued by the User’s country of origin, Permanent Stay Permit Card (KITAP) or Limited Stay Permit Card (KITAS) for foreign citizens;
e. Using the User’s own funds or Crypto Assets and not funds or Crypto Assets that originate from or belong to other people, or are the result of criminal acts, money laundering, terrorism financing and/or weapons of mass destruction; and
f. Has an active email address.
6.1.2. For legal entity User:
a. Agree to abide by this General Terms and Conditions and be legally competent to agree to this General Terms and Conditions;
b. Has and provides to Mobee a copy of the company deed of establishment containing the articles of association and its amendments along with the ratification, approval and/or receipt of notification from the Ministry of Law and Human Rights of Indonesia;
c. Has and provides to Mobee a copy of the Business Identification Number (NIB) and confirmation from the authorized institution/institution;
d. Domiciled within the territory of Republic of Indonesia;
e. Has and provides to Mobee an account on the Mobee Platform in its name as a legal entity only, and not as a mean for payment or transfer of funds or Crypto Assets by a statement letter made and signed by the authorized management and/or based on a power of attorney;
f. Using its own funds or Crypto Assets that originate from its own wealth and not funds or Crypto Assets that originate from or belong to other parties, or are the result of criminal acts, and proceeds of criminal acts including but not limited to terrorism financing, proliferation of weapons of mass destruction, corruption and financial crimes as stipulated in the applicable laws and regulations;
g. Has an active email address; and
h. Has appointed one or more people as the party authorized to represent and/or act for and on behalf of the company.
6.3. User is required to register on the Mobee Platform in order to have an account and make transactions on the Mobee Platform. In this case, User is required to provide information to Mobee in order to identify and verify User to ensure the accuracy and completeness of the data provided by the User and the User's background or profile. This identification and verification is carried out in order to implement the Know Your Customer (KYC) principle, conduct Customer Due Diligence (CDD) or Enhanced Due Diligence (EDD), detect fraud, money laundering, terrorism financing, and/or other financial crimes.
6.4. In order to register or open an account on the Mobee Platform, User is asked to carry out the following steps:
a. Select the “sign up” button, or register using Google Mail or Apple User ID.
b. User can also enter a referral code that the User obtains from someone else (if any). User can select the “do not have” button if they do not have a referral code.
c. Fill out the form with User's full name, email, phone number, one time password (OTP) code to verify User's phone number, nationality, password, and password confirmation, then check the general terms and conditions and privacy policy boxes and select the “sign up” button. One time password (OTP) to verify User's phone number can be obtained by selecting the “send” button after entering User's phone number.
d. Select the User's trading experience level, then select the "send" one time password (OTP) button to verify the User's email.
e. Enter the 6 (six) digit one time password (OTP) code sent to the User's email address, then select the "verify" button to verify the email.
f. Authorization email has been sent. User will be asked to click on the authorization link sent to User's email.
g. User can also enable notifications to get real-time updates by selecting the “turn on notification” button. User can also enable it later by clicking “later”.
h. After the registration process is complete, User can proceed to the Know Your Customer (KYC) process, by selecting the “verify account” button. User can also explore the Mobee Platform first by selecting the “explore Mobee” button.
i. User can access the Know Your Customer (KYC) process from the home page or from a message that appears when trying to access restricted parts of the Mobee Platform.
j. After selecting the “verify account” button, the User will be directed to the home page of Know Your Customer (KYC) verification. The User must grant camera access permission on the User’s device to ensure the Know Your Customer (KYC) process can run smoothly.
k. After selecting the “start verification” button, the User will be directed to the identity document verification page. The User can verify the identity document by taking a direct photo or uploading a photo of the identity document from the User’s device. If the User chooses to take a direct photo of the User’s identity document, the User must take a photo of the front side of the identity document using the camera in the Mobee Platform.
l. After successfully taking or uploading a photo of an identity document, the User can confirm to send it. The photo of the identity document can be sent if it is clearly visible.
m. After sending a photo of an identity document, the User proceeds to facial verification by taking a selfie directly using the front camera.
n. User can take a selfie by placing their face in the frame and selecting the camera icon. To ensure successful verification, User need to make sure they are not wearing any accessories (e.g. masks or hats) and take the selfie in a well-lit place.
o. If there are no problems, the User can send a selfie by selecting the “looks good” button to continue.
p. After taking a photo of the identity document and a selfie, the User must confirm the personal information on the basic information page, to ensure that the data displayed on the page matches the User’s identity document.
q. After confirming the information, the User needs to fill in information related to the Taxpayer Identification Number (optional), occupation, income, source of wealth, purpose of creating the account, and current address.
r. After submitting the information, the User can complete the verification process.
s. User must wait until the User verification process is approved (current verification status is pending).
t. Once successfully verified, User can start placing funds and using the various features available on Mobee.
u. If the User verification process is rejected, the User can restart the process by selecting the “verify account” button on the main page.
6.5. For legal entity User that wish to register or open an account, it is required to do the following:
a. Legal entity User can communicate in accordance with Article 18.1 of this General Terms and Conditions by stating that the legal entity User intends to register an account.
b. Legal entity User must be able to be verified by the person in charge (PIC) of Mobee. The legal entity User will be asked to identify by providing the following documents:
i. Copy of articles of association of the legal entity since establishment along with its amendments and its ratification;
ii. Copy of identity documents of the member of the board of directors and its representatives along with the original power of attorney (if any);
iii. Copy of Business Identification Number and business license issued by related authority;
iv. Customer identification number (CID) from a member of board of directors that has been verified pursuant to Article 6.4 above;
v. The original statement letter that shall be provided by person in charge (PIC) from Mobee; and
vi. Other documents as deemed necessary by Mobee for registration or account opening.
c. Legal entity User must wait until the verification process for the legal entity User is approved (the current verification status is pending).
d. After successful verification, the legal entity User carries out the steps as stated in Article 6.4 above.
e. Use of the account may only be carried out by members of the board of directors of the legal entity User in accordance with the provisions of its articles of association or representatives appointed based on a valid power of attorney (if any as submitted to Mobee in letter (b) above).
f. If the verification process for a legal entity User is rejected, the legal entity User can provide and/or re-complete the required documents as stated in letter b above.
6.6. User Account can only be used if the User has passed the identification and verification process. After the User has passed the identification and verification process, the User can create or change the password for the User account by using the features provided in the Mobee Platform.
6.7. The security and confidentiality of the User account and information related to the User account are entirely the responsibility of the User. In this case, any use, order, and/or command made through the User account is a legitimate request from the User concerned.
6.8. User Accounts can only be used and controlled by the User concerned. User are required to immediately notify Mobee if the User Account is used by another party and/or other violations occur.
6.9. If Mobee, based on its sole discretion, suspects that the User has committed an unlawful act, violation, crime, violated, exceeded or breached the Mobee Platform security system, committed any act that causes harm to Mobee and/or other User, and/or other acts that are contrary to this General Terms and Conditions and/or applicable laws and regulations or the User’s account has not been used for a certain period of time, then Mobee may freeze or close the User’s account, stop using the Mobee Platform, and take other actions deemed necessary with the aim of protecting the interests of Mobee and/or other User in accordance with applicable laws and regulations.
6.10. In the event of a User’s account being frozen or permanently closed, the User may make a withdrawal in accordance with the provisions for withdrawal of funds as stipulated in this General Terms and Conditions, provided that the User is required to settle all financial obligations owed to Mobee. For this purpose, Mobee may offset such outstanding financial obligations against the withdrawal proceeds that should be paid or returned to the User as a result of the freezing or permanent closure of the User account.
7. DATA UPDATES AND CHANGES
7.1. Updating and changing User data can only be done by the User concerned by requesting to update or changing User data.
7.2. User is required to update User data registered on the Mobee Platform in accordance with the current conditions of the User concerned.
7.3. Each User can request to update or change data by contacting Mobee according to the procedure set out in Number 18. Mobee will provide instructions, directions and documents that must be completed by User to be able to update User data.
7.4. Mobee at its own discretion can accept and reject requests to update User data if Mobee finds inaccuracies and/or errors in the provision of information from the User.
8. PERSONAL DATA
Provisions regarding the collection, storage, processing and use of User personal data are subject to and regulated based on the Privacy Policy which is an integral and inseparable part of this General Terms and Conditions.
9. TRANSACTION PROCEDURES
9.1. TRANSACTION OVERVIEW
9.1.1. User can determine sell or buy orders in 3 (three) ways, as follows:
a. User can buy and sell Crypto Assets at market prices;
b. User can determine the selling or buying price of Crypto Assets at a certain price;
c. User can set a stop price for the price of Crypto Assets. If the price has reached the stop price, the buy or sell transaction will be executed automatically by the Mobee Platform.
9.1.2. Before making a transaction on the Mobee Platform, the User must first place a deposit:
a. funds in Rupiah currency by transfer to a bank account available on the Mobee Platform, with the following provisions:
i. if using Bank BCA, minimum in the amount of Rp50,000 (fifty thousand Rupiah);
ii. if using quick response code (QR), minimum in the amount of Rp10,000 (ten thousand Rupiah);
iii. if using virtual account (VA), minimum in the amount of Rp10,000 (ten thousand Rupiah);
iv. if using e-wallet, minimum in the amount of Rp50,000 (fifty thousand Rupiah); and/or
b. Crypto Assets into the Wallet specified by Mobee which will be verified first by Mobee.
9.1.3. User can only make transactions on the Mobee Platform if the User has sufficient funds and/or Crypto Assets.
9.1.4. Mobee, based on its own discretion, has the right to reject and/or cancel a transaction, in the event Mobee knows and suspects that there is a crime or violation in the transaction. Mobee is not responsible if Mobee or another party fails or delays the implementation of the transaction in question.
9.1.5. User cannot cancel any transactions that have been made and completed through the Mobee Platform.
9.1.6. User can access the trading history made by User on the Mobee Platform. All transaction data made by User through the Mobee Platform will be automatically recorded on the Mobee Platform. User cannot change or modify the transaction data made by the User in order to maintain the accuracy of the Crypto Assets trading history on the Mobee Platform.
9.1.7. User is fully responsible for carrying out transactions within the Mobee Platform correctly.
9.2. PLACEMENT OF FUNDS
9.2.1. The steps for placing funds are as follows:
a. User can make a deposit from the home page or Wallet page. Selecting the “deposit” button will open a panel where users can choose the method of depositing funds.
b. User choose the method of fund placement. Mobee provides 5 (five) different methods, namely bank transfer, virtual account, quick response code (QR), e-wallet, or Crypto Assets.
c. If User choose the method of placing funds via bank transfer, User can choose to place funds from a bank by transfer using a unique code, or use a virtual account with another bank listed on the page.
d. If choosing bank transfer, User must determine the amount of funds they wish to deposit and follow the transfer instructions.
e. If User chooses a virtual account, User will be given a virtual account number that will be used for the transfer, and the balance will be entered immediately after the transfer is complete.
f. If the User selects the quick response (QR) code, the User will be given a unique barcode that can be scanned by the User which will only be valid for a certain period of time.
g. If User chooses to transfer via e-wallet, User can choose the e-wallet provider to be used.
h. The User enters the amount of funds they wishes to place.
i. Once User confirms the amount of funds placed and the method, User will be redirected to the native e-wallet screen where the User can authorize the transfer.
j. After successful fund placement, the system will credit funds in Rupiah currency to User’s Wallet.
9.3. PLACEMENT OF CRYPTO ASSETS
9.3.1. The steps for placing Crypto Assets are as follows:
a. User choose to deposit using Crypto Assets.
b. User will be directed to the Crypto Asset selection page and select the type of Crypto Assets they wish to place.
c. For the first placement through the selected network, User needs to create a wallet address for placement first. This step only needs to be done once.
d. Quick response (QR) code and Wallet address will be available for User to copy, so that User can immediately start placing Crypto Assets into User’s Wallet.
9.4. BUYING AND SELLING CRYPTO ASSETS
9.4.1. The steps for buying and selling Crypto Assets are as follows:
a. User can access Crypto Assets trading via the market icon on the bottom navigation bar, select the type of Crypto Assets they wish to buy or sell, and will be redirected to the Crypto Assets type page. User can open the Crypto Assets trading page by selecting the “buy” or "sell" button at the bottom of the Crypto Assets page.
b. User can also access Crypto Assets trading by clicking the “trade” icon on the bottom navigation bar, then click the “trade” button".
c. On the trading page, User can:
i. Selecting Crypto Assets or other pairs;
ii. Interact with Crypto Assets charts;
iii. Switch between buy and sell orders
iv. Choosing order type:
1) Market Order: Executed at the current market price, regardless of the limit price. Used to buy or sell Crypto Assets instantly at the best available price.
2) Limit Order: User specify a maximum (to buy) or minimum (to sell) price. The transaction will only be executed if the market price reaches that limit.
3) Stop Market Order: Becomes a market order after reaching a certain price (stop price), usually used to limit losses.
4) Trailing Stop Order: Allows User to buy at a lower price or sell at a higher price based on a percentage or a fixed amount as a trail;
5) Spot Grid: Mobee's automated spot trading feature that periodically uses limit orders to buy and sell crypto assets within a specific price range. This strategy helps users buy and/or sell crypto assets without having to constantly monitor the market.
v. Fill out the form with trading details;
vi. Check open orders for all trades, cancel orders if desired, and filter by selected pairs;
vii. Check User's order history by selecting the “history” button.
d. Buy Market Order:
i. Enter the amount you want to buy or the amount of Crypto Assets you want to get;
ii. After selecting the “buy” button, the order will be executed instantly at the nearest ask price in the order book;
iii. Order details can be seen on the transactions history page.
e. Buy Limit Order:
i. Enter the desired maximum price, below the current market price;
ii. Select the capital to be used or the amount of Crypto Assets to be purchased;
iii. After selecting the “buy” button, the order will appear in the open orders section;
iv. User can view order details by pressing the order in the User’s history;
v. Orders are executed if the ask price reaches the specified limit;
vi. User can cancel orders by pressing the “cancel order” button on the order details page.
f. Buy Stop Market Order:
i. Enter a stop price above the market price to trigger a market order;
ii. Select the capital or amount of Crypto Assets the User wants to buy;
iii. After clicking “buy”, the order will appear in the open orders section and will be executed if the ask price reaches the stop price;
iv. User can view order details by selecting the order card in the open orders section;
v. The order will be executed as soon as the ask price reaches the stop price, and will then be executed as a market order;
vi. User can cancel orders at any time by selecting the “cancel order” button on the order details page.
g. Buy Trailing Stop:
i. User choose between a percentage or a fixed amount for the trailing amount:
1) If selecting a percentage, User can choose between 5% (five percent) and 10% (ten percent).
2) If selecting a fixed amount, the User can enter the trail amount manually;
ii. User can choose the amount of capital they want to use to buy Crypto Assets or determine the amount of Crypto Assets they want to buy;
iii. After clicking the “buy” button, a stop market order will appear in the open orders section;
iv. User can view order details by clicking on the order card in the open orders section;
v. Trailing stop order will change to market order when the Crypto Assets price reaches the trailing price;
vi. User can cancel orders at any time by selecting the “cancel order” button on the order details page.
h. Sell Market Order:
i. Enter the amount of Crypto Assets to be sold or the desired money target;
ii. Select the “sell” button, the order will be executed immediately at the nearest bid price;
iii. Order details can be seen in the transaction history.
i. Sell Limit Order:
i. The User enters the minimum price (limit price) at which the User wants the order to be executed;
ii. User can choose the amount of capital they want by selling Crypto Assets or determine the amount of Crypto Assets they want to sell;
iii. After selecting the “sell” button, a limit order will appear in the open orders section;
iv. User can view order details by clicking on the order card in the open orders section;
v. The order will be executed as soon as the bid price reaches the specified ask limit price;
vi. User can cancel orders at any time by selecting the “cancel order” button on the order details page.
j. Sell Stop Market Order:
i. User enters a stop price below the current market price, which will activate a market order;
ii. User can choose the amount of capital they want to use to sell Crypto Assets or determine the amount of Crypto Assets they want to sell;
iii. After clicking the “sell” button, a limit order will appear in the open orders section;
iv. User can view order details by clicking on the order card in the open orders section;
v. The order will be executed as soon as the bid price reaches the stop price, and will then be executed as a market order;
vi. User can cancel orders at any time by selecting the “cancel order” button on the order details page.
k. Sell Trailing Stop:
i. User choose between a percentage or a fixed amount for the trailing amount:
1) If selecting a percentage, User can choose between 5% (five percent) and 10% (ten percent).
2) If you choose a fixed amount, the User can enter the trail amount manually;
ii. User can choose the amount of capital they want to use to sell Crypto Assets or determine the amount of Crypto Assets they want to sell;
iii. After selecting the “sell” button, a limit order will appear in the open orders section;
iv. User can view order details by selecting the order card in the open orders section;
v. Trailing stop order will change to market order when the Crypto Assets price reaches the trailing price;
vi. User can cancel orders at any time by selecting the “cancel order” button on the order details page.
l. Spot Grid:
i. User select the Crypto Assets to be traded. Currently, the Crypto Assets available for Spot Grid are:
1) Bitcoin (BTC);
2) Ethereum (ETH);
3) Tether Gold (XAUT);
4) Binance Coin (BNB);
5) XRP (XRP);
6) Hyperliquid (HYPE); and
7) Fart Coin (FART).
ii. User create their own strategies or choose strategies available as recommendations for User with options:
1) Fast Pace: Smaller profits per trade with higher transaction frequency and a smaller price range. Suitable for active markets and short-term trades; or
2) Steady: Higher profits on each trade with low trading frequency and a wider price range. Suitable for stable markets and long-term trading.
iii. If the User chooses to create their own strategy, the User can set their own lowest and highest price range.
iv. The User chooses to use the desired model, namely:
1) Arithmetic: Sets the equivalent price difference for each grid.
For example: if the lowest price is Rp10,000 (ten thousand Rupiah) and the highest price is Rp20,000 (twenty thousand Rupiah), then using 5 (five) grids, then the price difference in each grid is Rp2,000 (two thousand Rupiah); and
2) Geometric: Sets the price difference using a fixed percentage. For example, if you select 5% (five percent), the price difference in each grid will be 5% (five percent) from the lowest price.
v. User choose the amount of capital they want to use for Spot Grid or determine the amount of Crypto Assets they want to use for Spot Grid.
vi. In the Start Condition option, the User can select the start time of the Spot Grid transaction.
vii. After selecting the “Make Strategy” button, a confirmation page will appear for the User to confirm by selecting the “Confirm” button.
viii. User can view order details on the Spot Grid main page.
ix. User can cancel orders at any time by selecting the “End the Strategy” button on the strategy details page.
x. When canceling an order, the User can choose to receive the Crypto Assets used for Spot Grid converted into USD Tether (USDT) or not.
9.5. CRYPTO ASSETS CONVERSION
9.5.1. The steps to convert Crypto Assets are as follows:
a. User can access the instant convert feature via the main page, Wallet page, individual Crypto Assets type pages in the Wallet, or the trading page;
b. The instant convert feature allows novice User to experience buying and selling Crypto Assets;
c. The amount the User want to sell or buy, the other side will be filled automatically;
d. After all the information is entered, the User can select the “swap” button which lights up;
e. The “swap” button will remain greyed out and cannot be selected until the correct information has been entered;
f. After that, a confirmation drawer for the Customer’s order will appear;
g. Selecting the “confirm” button will execute the exchange;
h. Confirmation details will appear after the exchange is made.
10. TRANSACTION FEES, WITHDRAWAL OF FUNDS AND CRYPTO ASSETS, AND TRANSFER OF CRYPTO ASSETS
10.1. User will be charged a transaction fee of Rp5,000 (five thousand Rupiah) for each withdrawal of funds.
10.2. Crypto Assets withdrawal transaction fees vary depending on the blockchain network used. However, transaction fees can change at any time, depending on market price conditions. For example, if a transaction is made using the current Ethereum network, the transaction fee (gas fee) charged is 0.005 ETH or equivalent to Rp172,813 (one hundred seventy two point eight one three Rupiah).
10.3. Mobee may change and determine other transaction fees from time to time, by providing prior notification to the User.
10.4. User can withdraw funds and/or Crypto Assets from the Mobee Platform with the following provisions:
a. User has fulfilled all financial obligations to Mobee and other third parties, including service providers as referred to in Number 4.2 of this General Terms and Conditions, in accordance with applicable laws and regulations;
b. Withdrawal of funds and/or Crypto Assets has been verified;
• The maximum daily withdrawal limit is Rp750,000,000 (seven hundred fifty million Rupiah). Subject to the terms and procedures determined by Mobee, User may apply for a higher maximum withdrawal limit change; and
• User is required to comply with and follow every process determined by Mobee in connection with the withdrawal of funds and/or Crypto Assets, as well as applicable laws and regulations.
10.5. In case of withdrawal of funds, the following provisions will apply:
a. User must state the amount of funds to be withdrawn and the User's bank account number registered at the time of registering the User’s account on the Mobee Platform;
b. Withdrawals must be made in Rupiah currency;
c. For User who does not have a bank account at a supported bank available on the Mobee Platform, the User will not be able to withdraw funds.
10.6. In case of Crypto Assets withdrawal, the User must specify (i) the type and amount of Crypto Assets withdrawn; (ii) the User's full name; and (iii) the User's Wallet address.
10.7. Crypto Assets withdrawals can only be made if:
a. The identity of the withdrawer, the party receiving the withdrawal, or the recipient Wallet is the same as the User’s identity; and
b. Verification results show the conformity between the Crypto Assets withdrawal request and the balance or ownership record of the Crypto Assets.
10.8. User can transfer Crypto Assets to another User’s Wallet within the Mobee Platform or to a Wallet outside the Mobee Platform. Mobee will verify the transaction of transferring Crypto Assets to another User’s Wallet within the Mobee Platform or to a Wallet outside the Mobee Platform.
10.9. If the User transfers Crypto Assets less than the value in Rupiah equivalent to USD1,000 (one thousand United States Dollars), then the User must provide the following information:
a. The blockchain network used;
b. Full name of sender and recipient;
c. Sender and recipient Wallet addresses;
d. Type and amount of Crypto Assets transferred.
10.10. If the User transfers Crypto Assets of more than or equal to the value in Rupiah equivalent to USD1,000 (one thousand United States Dollars), then the User must provide the following information:
a. The blockchain network used;
b. Full name of sender and recipient;
c. Sender and recipient Wallet addresses;
d. Sender and recipient’s residential addresses;
e. Type and amount of Crypto Assets transferred.
10.11. User is fully responsible for making withdrawals of funds and Crypto Assets and transferring Crypto Assets as referred to in Number 10 via Mobee Platform correctly, and ensuring the accuracy of any information provided.
11. TRANSACTION SECURITY
To ensure the security of transactions carried out by User on the Mobee Platform:
a. Most Crypto Assets will be stored in safe storage (cold storage);
b. Any large amount of Crypto Assets trading transaction requires Google 2FA authentication. This is intended to ensure that the User is conducting the transaction through his/her own equipment;
c. Every withdrawal of funds or Crypto Assets requires phone number, email and Google 2FA authentication;
d. The Mobee platform will offer User the ability to use a special IP address where User can only log into their account when they are connected to that special IP address;
e. The Mobee platform will send a short message that will appear on the User’s device screen (push notification) and notification via electronic mail to the User when there is a transaction to buy or sell Crypto Assets carried out in the User’s account concerned;
f. Mobee will conduct audits periodically, especially when Mobee is about to upgrade or add features to the Mobee Platform. Every 6 (six) months, Mobee will also conduct tests to identify weaknesses in the Mobee Platform.
12. REPRESENTATIONS, WARRANTIES, AND COVENANTS
12.1. The User declares and warrants that this General Terms and Conditions are a valid and legally binding agreement for the User.
12.2. The User guarantees that the information provided in connection with the use of the Mobee Platform and for the purposes of establishing this General Terms and Conditions is accurate and complete in all respects.
12.3. The User has read and understood all of this General Terms and Conditions and in good faith will carry out all of the terms, conditions, obligations and responsibilities as stipulated in this General Terms and Conditions.
12.4. The User has obtained the necessary approval and is legally competent to bind themselves, to enter into this General Terms and Conditions including to carry out and comply with their obligations as stipulated in this General Terms and Conditions.
12.5. The User declares and guarantees that the provision of this General Terms and Conditions will not violate or conflict with applicable laws and regulations and any agreement to which the User is a party.
12.6. User shall not use the Mobee Platform in order to trade Crypto Assets related to: (i) narcotics; (ii) goods and/or services that violate intellectual property rights; (iii) ammunition, firearms, explosives, sharp weapons; (iv) goods and/or services that display personal information of third parties that violate the law; (v) gambling; (vi) services related to smuggling outside the territory of the Republic of Indonesia; (vii) support for organizations that are prohibited or banned by the government; and (viii) actions or transactions that are contrary to or prohibited by laws and regulations.
12.7. The User hereby agrees and grants full power and authority to Mobee to use all data, documents and/or information obtained by Mobee regarding the User (including but not limited to the User’s transaction data) in connection with all other purposes as may be permitted by applicable laws and regulations, including those intended for marketing Mobee products or other parties, who cooperate with Mobee. In the event of any use of data that requires the consent of another party, the User hereby declares and guarantees that they have obtained the consent of the other party for the use of such data, statements and information.
12.8. User shall not provide, rent, sell, transfer and/or assign User accounts either in part or in whole to any other party for any reason, to carry out transactions other than those specified in the General Terms and Conditions for any purpose.
13. IMPLEMENTATION OF ANTI-MONEY LAUNDERING AND PREVENTION OF TERRORISM FINANCING AND PROLIFERATION OF WEAPONS OF MASS DESTRUCTION PROGRAMS (AML/CFT)
In accordance with applicable laws and regulations, Mobee implements the Anti-Money Laundering and Prevention of Terrorism Financing (AML-CFT) and Proliferation of Weapons of Mass Destruction (WMD) programs. In relation with this, Mobee has designed an Anti-Money Laundering and Prevention of Terrorism Financing (AML-CFT) policy with the aim of preventing money laundering and terrorism financing by having a system that can reduce the risk of Mobee being used to carry out money laundering and terrorism financing activities. Mobee hereby has the authority to suspend, postpone, and/or reject any application for account registration and/or transaction made by the User in the event there is an indication of a violation by the User of these matters, including reporting suspicious activities internally and to the authorities. Hereby the User understands, acknowledges and agrees that they shall not file any objections regarding the actions taken by Mobee in relation with the implementation of the program (including requests for further information regarding the User’s transaction pattern), to know Your Customer (KYC) process, and to conduct Customer Due Diligence (CDD) or Enhanced Due Diligence (EDD).
14. SYSTEM MAINTENANCE
Mobee has the right to perform scheduled maintenance on servers, systems and applications that support the Mobee Platform. In connection with such scheduled maintenance, trading and/or other functions within the Mobee Platform may be unavailable during scheduled maintenance. Prior to conducting scheduled maintenance, Mobee will provide prior notice to the User regarding this scheduled maintenance via email and/or the Mobee Platform no later than 3 (three) days prior to the scheduled maintenance. The User acknowledges the possibility of unforeseen incidents or urgent issues that may arise and require immediate maintenance by Mobee. In the event of unscheduled maintenance due to unforeseen incidents or urgent issues, Mobee will make every effort to promptly notify the User of such conditions and the estimated duration of the maintenance.
15. INTELLECTUAL PROPERTY RIGHTS
15.1. Mobee or Affiliate (as the case may be) is the owner of the Mobee Platform and all intellectual property rights related to the Mobee Platform.
15.2. User may only use the intellectual property rights related to the Mobee Platform as permitted by Mobee in the context of using the Mobee Platform in accordance with this General Terms and Conditions.
15.3. User is not permitted to reproduce, distribute, publicly disclose or in any way exploit the Mobee Platform, the intellectual property rights associated with the Mobee Platform, or any content or information that User can access from the Mobee Platform.
16. RELEASE AND INDEMNITY
The User hereby agrees to release and discharge Mobee, including but not limited to directors, commissioners, officers, employees, consultants, lawyers, contractors, agents and representatives of Mobee from and against claims, damages, costs arising in connection with (i) violations of this General Terms and Conditions and applicable laws and regulations, (ii) false or misleading statements and warranties, (iii) the User’s use and activities on the Mobee Platform, or (iv) the User's negligence.
17. LIMITATION OF LIABILITY
17.1. The information provided on the Mobee Platform is general information and is not intended to provide advice, including investment and financial advice that can be relied upon by User. User is advised to continue to obtain professional or specialist advice before taking action based on the information provided on the Mobee Platform.
17.2. Under no circumstances shall Mobee be liable to the User for any losses caused by any error made by the User as follows (whether such losses are foreseeable or known): (i) indirect, incidental, special, or consequential losses, (ii) loss of actual or anticipated profits, (iii) loss of revenue, and (iv) loss of anticipated savings.
18. NOTICE AND COMPLAINT SERVICE
18.1. User agree that any communication with Mobee will be carried out via electronic mail with an email address [email protected].
18.2. Any communication and notice given in electronic format shall be deemed to be written communication and notice.
18.3. User is required to immediately notify Mobee if there is any misuse of the User's account and/or the Mobee Platform, fraudulent attempts, suspicious activity, or other incidents that may affect the User and Mobee.
18.4. User agrees to receive notifications from Mobee regarding the use of the Mobee Platform, including but not limited to User accounts and transactions, as well as promotions.
18.5. In addition to electronic mail as referred to in Number 18.1 above, Mobee also provides communication or complaint services provided on the Mobee Platform, namely a chatbot feature that will help answer and respond to any complaints, obstacles, questions, and suggestions from User before being responded to by Mobee User service representatives if necessary. For time efficiency and providing effective feedback to User, Mobee also provide tabs features and Frequently Asked Questions (FAQ) provided on the Mobee Platform.
18.6. In submitting complaints, obstacles, questions, and suggestions, User must provide sufficient information so that they can be followed up. Mobee will study and review every complaint, obstacle, question, and suggestion from User with great care before making a decision and providing a response with the aim of ensuring User satisfaction.
18.7. If the complaint cannot be settled through the complaint service provided by Mobee, so it becomes a Dispute, then Mobee and the User agree to settle the Dispute through Dispute settlement as regulated in Number 20 of this Terms and Conditions.
19. CONFIDENTIALITY
19.1. Mobee and the User agree to keep confidential and not to use, disclose or leak to any third party or to allow or cause anyone to know any information relating to this General Terms and Conditions, including the implementation hereof, including but not limited to its processes and procedures, source and object code, software, computer records, computer programs, distribution data, price lists, User information and technical information (“Confidential Information”). All Confidential Information will be used only for the purposes of this General Terms and Conditions.
19.2. Each of Mobee and the User may disclose Confidential Information to its affiliated companies, directors, board of commissioners, employees, officers and consultants limited to User who need to know the Confidential Information provided and Mobee or the User (whichever is relevant) must ensure that the affiliated companies, directors, board of commissioners, employees, officers and/or consultants comply with the confidentiality provisions under this General Terms and Conditions.
19.3. The confidentiality obligations under this General Terms and Conditions do not apply to information that:
19.4. The confidentiality obligations under this General Terms and Conditions shall continue to apply after termination of this General Terms and Conditions.
20. GOVERNING LAW AND DISPUTE SETTLEMENT
20.1. This General Terms and Conditions is governed and interpreted under the laws of the Republic of Indonesia.
20.2. Any Dispute must be settled through amicable settlement within a period of 30 (thirty) calendar days after written notification of the Dispute which must be submitted by registered mail to Mobee. In the event that the Dispute cannot be settled through amicable settlement within a period of 30 (thirty) calendar days, then Mobee and the User may settle the Dispute using the procedures as stipulated in the Futures Exchange Regulations and Rules or OJK Regulations.
20.3. If the Dispute cannot be settled by the procedures as set out in Number 20.2 above, then the Dispute shall be settled through the Alternative Dispute Resolution Institution (LAPS) OJK or South Jakarta District Court.
21. FORCE MAJEURE
Mobee’s responsibilities and obligations under this General Terms and Conditions and the use of the Mobee Platform may be disrupted due to circumstances beyond Mobee’s authority and control, including but not limited to unforeseen national labor conflicts, acts of God, earthquakes, requisitions, seizures, and commands from government authorities, public decisions, riots, rebellions, telecommunication disruptions, power outages (“Force Majeure”). The User hereby agrees to release and discharge Mobee from and against claims, damages, costs arising in connection with the disruption of the implementation of Mobee’s responsibilities and obligations under this General Terms and Conditions and the use of the Mobee Platform as a result of Force Majeure. Mobee has the right and authority to stop the Mobee Platform including activities therein when Force Majeure occurs.
22. MISCELLANEOUS PROVISIONS
22.1. In the event of any conflict between this General Terms and Conditions and other agreements, policies, terms and conditions relating to the use and trading of Crypto Assets on the Mobee Platform, this General Terms and Conditions shall apply.
22.2. User may not transfer any rights and obligations in this General Terms and Conditions, either in part or in whole, to any party without prior written consent from Mobee. However, Mobee may transfer any rights and obligations in this General Terms and Conditions, either in part or in whole, to any party without prior written consent from the User or written notice to the User.
22.3. The User understands and agrees that this General Terms and Conditions, documents, and notices in connection with the Mobee Platform are made in electronic form. Therefore, the User will not file any claims or objections in any form regarding the existence and validity of this General Terms and Conditions, documents, and notices made electronically.
22.4. Any express or implied waiver by Mobee of any right or relief to a User shall not constitute a continuing waiver of the waived right or relief or a waiver of any other right or relief.
22.5. If any provision of this General Terms and Conditions is held to be invalid or unenforceable by any judicial authority or other competent authority, the other provisions of this General Terms and Conditions shall remain in full force and effect and shall not be impaired in any way.
22.6. This General Terms and Conditions shall remain in effect after the termination, closure or freezing of the Mobee Platform, whether temporarily or permanently.
22.7. This General Terms and Conditions are made in English and Indonesian. If there is any conflict or inconsistency between the English and Indonesian versions, the Indonesian version shall prevail.
